Agreeing to these terms

By creating an account or using the Tipsy Steward Cigar Lounge (the "app"), you agree to these terms and to the Privacy Policy. If you do not agree, do not use the app. On iPhone and iPad, Apple's standard Licensed Application End User License Agreement also applies; if the two conflict on a point that Apple's agreement covers, Apple's agreement wins. Who may use it

You must be 21 or older, wherever you live, and you must be allowed by the laws where you are to possess and use tobacco products. The app is about cigars and is not for anyone younger. You are responsible for keeping your password private and for what happens under your account.

What the app is

The Cigar Lounge is a personal record-keeping tool: a humidor inventory, a smoking journal, and optional sharing with friends. Nothing is for sale in the app. It does not sell tobacco, take orders, or link to anywhere that does, and nothing in it is an advertisement or a promotion of any tobacco product. Cigars are not a safe product; smoking causes serious disease. Nothing in the app is health advice.

Your content

Everything in the app is user-generated content: the cigars you list, the prices, notes, flavors and star ratings you record, and the photos you take or upload. It is entered by you, not by us.

You own it. We claim no ownership of your content.
You are responsible for it. You confirm that you have the right to add what you add, including any photo, and that it does not break the law or anyone's rights.
What we do with it. You give us permission to store it, to show it to you, to show the parts you choose to share to the people you share with (and, as an anonymous number only, in community averages unless you opt out), and to pass it to the service providers named in the Privacy Policy so the app can work. That permission ends when you delete the content or your account.
We do not check it. We do not create, edit, verify or endorse user content, and we are not responsible for its accuracy.

Suggestions and prices are estimates

Cigar names read from a photo, and price (MSRP) figures, are automated estimates, shown in US dollars. They can be wrong. They are not offers, quotes or advertisements, and are not a guarantee of what anything costs or is worth. Check anything that matters, and decide for yourself before you rely on it.

Sharing and ratings

If you share your humidor, you are choosing to let that person see what the Privacy Policy says they can see. Only enter the email of someone who is expecting it. You can revoke a share at any time. Do not use sharing, ratings or any other part of the app to harass anyone, or to mislead people about a cigar.

Acceptable use

Do not use the app to break the law, to sell or advertise tobacco or anything else, or to upload content that is unlawful, abusive, or that you have no right to use.
Do not try to break, overload, scrape or reverse-engineer the app, or to reach another person's data.
Do not share your account, or create accounts to avoid limits.

We may remove content, or suspend or close an account, that breaks these rules. You can delete your account yourself at any time from inside the app; that removes your data permanently.

Pro, credits and payments

Pro and credit packs are optional purchases made through Apple (on iPhone and iPad) or Google (on Android), and are charged to your Apple or Google account at the price shown to you before you buy, in your local currency. Pro renews automatically until you cancel it in your Apple or Google account settings, at least 24 hours before the period ends. A credit pack is a one-time purchase and does not renew. Refunds are handled by Apple or Google under their own policies. Features and limits can change; the allowances shown in the app at the time you buy apply.

Things we do not promise

The app is provided as is. We work to keep it running and your data safe, but we do not promise it will always be available or error-free, and you should not treat it as the only copy of anything you cannot lose (you can export your humidor as a CSV file and save your photos from the app). The app depends on other companies' services (named in the Privacy Policy), and we are not responsible for their outages.

Limits on our responsibility

To the fullest extent the law allows, the operator is not liable for indirect or consequential loss, lost data, or any decision you make based on the app's suggestions or estimates, and total liability for any claim is limited to the amount you paid for the app in the 12 months before it arose. Nothing here limits any right you have by law that cannot be waived, including consumer rights where you live, or liability that cannot lawfully be limited.

Changes and ending

We may update these terms. If a change matters, the date at the top will change and the app will say so; continuing to use the app afterwards means you accept the new terms. You may stop using the app and delete your account at any time. We may stop providing the app, with reasonable notice where we can give it. These terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-law rules, except that any rights you have under the law where you live that cannot be waived still apply.
